I found an article on a NY racing board about a Florida supreme court decision saying Parents Cannot Sign Binding Liability Waivers For Kids Who Race. I’m surprised there hasn’t been any discussion here. Take a look at the following link.

Regardless of what you sign, you retain the right to file a lawsuit if the facility can be proven to be at least partially at fault for whatever happens.

Just ask any promoter and if he is honest about it he will tell you this is correct. Frequently the waiver is not worth the paper it is printed on! Check out the number of lawsuits filed against racing facilities and you will see.

You are correct, anyone can file a suit for anything. I think this ruling will affect how insurance companies end up insuring race events and facilities if they allow minors to participate.

This happend at the Thundercross Motorsports facility before it closed.

Actually it was at the MX track at Thundercross and they just recently re-opened the MX track. A lot of this stems from the fact that the parents were seperated and the Mom supposedly didn’t know what the kid was doing when off with Dad. Dad was the one signing the waiver allowing the kid to race at the MX track. Also the kid had previously wrecked on the track at the same jump several times before.

I’m part of an ATV riding park up in N. Florida and we are watching this very closely, as we hold several kids races during our feature weekends. Not yet sure how this is going to impact us. :frowning:

so obviously it was a problem with the track and not with the kid’s driving ability, eh? :dry:

The paper is NOT GOOD

When you sign the waiver, that is to put your name in the insurance records. The insurance at the track DOES NOT COVER ANYTHING but the TRACK it is their liability coverage.
With that said anyone who signs thte sheet for a MINOR takes on the LIABILTY of that minor. Hello Courts.
